ReachOut.com: Reach in for ReachOut.com Competition

 

Terms & Conditions 

 

1. Information on how to enter the Reach in for ReachOut.com Competition and prizes forms part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.

 

2. Entry is only open to Australian residents aged between 14 and 25 years of age. If an entrant is under the age of 18, they must obtain parent or guardian approval of these Terms and Conditions before submitting an entry. Directors, management, employees and contractors (and their immediate families) of the Promoter, or of the agencies and companies associated with this competition are ineligible to enter. 

 

3. The competition commences at 10.00 am AEDST on 21/07/2010. Entries close at 5.00 pm AEDST on 16/08/2010 (“Competition Period”). Any entry received after the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries. 

 

4. To enter the competition, entrants must visit http://www.youtube.com/group/reachinforreachout and submit the video of their story to the group during the Competition Period. Entrants must register or already be a member of YouTube and login to their account to upload a video. Videos must be in the YouTube acceptable format and comply with the YouTube Terms of Use, and it is suggested video length ranges between 30 seconds to 2 minutes. 

 

5. Entries must be made by individuals only. There is no limit on the number of videos an entrant can submit. 

 

6. This competition is a game of skill. Chance plays no part in determining the winner. 

 

7. There will be only one major prize awarded. The prize is a 160GB iPod classic® valued at RRP$329, a $50 iTunes® voucher and a Nikon COOLPIX P100 Digital Camera valued at $599.99. Total prize pool valued at $978.99. Prize value is the recommended retail price as at 15/07/10.

 

8. The winner will be the entrant with the highest rated video in accordance with the YouTube ranking system at the end of the Competition Period. In the event that there is a draw, the video that has been uploaded to the group first in the Competition Period will be deemed the winner. 

 

9. The Promoter’s decision in relation to all aspects of the competition is final and no correspondence will be entered into. 

 

10. The winner will be notified through their YouTube account by YouTube private message, at which time arrangements for delivery of the prize will be made. Entrants are responsible for ensuring all personal information entered in their YouTube account is correct and complete. The Promoter is not responsible for any failure to contact a Prize Winner as a result of incorrect information. 

 

11. The winner will be notified by 5.00 pm AEST on Friday 20/08/2010, and their details will also be published on the Reach Out Australia Facebook and Twitter pages on the same date.

 

12. If the Promoter is unable, following reasonable efforts, to contact the winner to notify them that they have won and arrange fulfilment of the prize, that winner will forfeit the prize in its entirety and it instead will be awarded to the first runner up in the promotion (being the entrant with the second highest rated video in accordance with the YouTube ranking system).

 

13. The Promoter reserves the right to request the winner to provide proof of identity, proof of age and/or proof of entry validity in order to claim a prize. Proof considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

 

14. Prizes are not transferable or exchangeable and cannot be taken as cash. Prizes are subject to any terms and conditions imposed by the supplier, including voucher expiry. The Promoter accepts no responsibility for any variation in prize value.

 

15. The Promoter accepts no responsibility for any tax implications that may arise from the receipt of any prize. Independent financial advice should be sought.

 

16. In the event any prize or prize component is unavailable for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right to substitute the prize or prize component with another prize of equal or greater value and the winner will be notified accordingly. 

 

17. All entrants consent to the Promoter using the entrant’s video on the ReachOutAus YouTube channel and associated YouTube pages, the ReachOut_Aus Twitter feed, the Reach Out web site, the Reach Out Australia Facebook page and other social media and media websites, and internal promotional purposes, without attribution to the entrant or payment for use of the entrant’s video. 

 

18. All entrants warrant and agree that:- 

a) all entries are the entrant’s own original work; 

b) entrants have obtained permission from all persons featured in their video; 

c) entrants will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless the entrant is the owner of such rights; 

d) entrants will not submit material that is unlawful, obscene, defamatory, derogatory, threatening, pornographic, sexually inappropriate, violent, abusive, harassing, hateful, racially, religiously or ethnically offensive, not suitable for children aged under 15, or encourages conduct that would be considered a criminal offense, gives rise to civil liability, or violates any law; and 

e) entries must not contain viruses or cause injury or harm to any person or entity. 

 

19. The Promoter reserves the right to remove, without notice to the entrant, any video which in the Promoter’s opinion is or may be in breach of any of these Terms and Conditions, YouTube’s Terms of Use or is otherwise inappropriate. The Promoter reserves the right to disqualify any entrant who submits an entry which is not in accordance with these Terms and Conditions or YouTube’s Terms of Use, or tampers with the entry and/or YouTube rating process, or otherwise engages in any unlawful or other improper conduct calculated to jeopardize the fair and proper conduct of this competition. 

 

20. Without limiting any other terms, the entrant indemnifies the Promoter for any breach of the terms herein, and irrevocably and unconditionally releases the Promoter from any and all liabilities, claims and demands of any kind or nature, whatsoever in law or equity, whether known or unknown, arising out of or related to the prize, or this competition, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 

 

21. Any cost associated with accessing the competition website is the entrant’s responsibility and is dependent on the internet service provider used. The Promoter is not responsible for any problems or technical malfunction of any computer equipment, software, technical problems, traffic congestion, or any combination thereof, or any other technical failures including any damage to entrant’s or any other person’s computer related to, or resulting from, participation in this competition or the downloading of any materials related to this competition.

 

22. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the reasonable control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition or invalidate any affected entries.

 

23. This competition and all entries are subject to YouTube Terms and Conditions of Use and copyright guidelines. Such terms will prevail to the extent of any inconsistency with these Terms and Conditions. 

 

24. The personal information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. Unless otherwise advised by entrants, the Promoter may use entrants’ information for future promotional, marketing and publicity purposes including contacting the entrant by electronic message or telephone. If an entrant does not wish to be contacted for these purposes or wishes to access, update or correct any of their personal information, they should contact the Promoter at the address below. A copy of the Promoter’s Privacy policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
