Reach Out member terms

1.  Before registering as a member of Reach Out you must agree to these member terms and conditions ("Member Terms"). The Member Terms are designed to ensure that your use of the Reach Out site as a member does not break any laws. The Reach Out site is operated by the Inspire Foundation and any reference to Reach Out includes the Inspire Foundation.

2.  By clicking the "I ACCEPT" button, you agree to be bound by these Member Terms, as well as any other terms and conditions displayed on the Reach Out site. If there is any inconsistency between the Member Terms and any other Reach Out terms and conditions, the Member Terms prevail to the extent of the inconsistency.

3.  You must not disclose your user name or password to any person. You must take all reasonable steps to keep your username and password secure so that it is not copied or used by any person. You must immediately notify Reach Out if you become aware that another person has used your user name or password.

Upon receipt of notification of use by another person, Reach Out will deactivate your user name and password, and you will be required to create a new user name and password.

4.  You must not submit, post or upload any material to the Reach Out site which:

   (a)  is inappropriate, offensive or contrary to any applicable laws or standards. This includes, without limitation, material which:

        (i)  is obscene or indecent, depicts violence, sexual activity or pornography; or contains  instructions in crime or drug use; or

        (ii)  defames, harasses, menaces, threatens, abuses, offends or embarrasses any person;

   (b)  infringes the copyright, moral rights, confidentiality rights or intellectual property rights of any person, for example, by reproducing songs, poems, articles, logos, trade marks, pictures, photos, music or other material that is not owned by you (or which you do not have a license to reproduce on the site);

   (c)  infringes any of our rights or the rights of any third person including privacy rights;
 
   (d)  breaches any laws, regulations, standards or codes as enacted modified or updated from time to time;

   (e)  impersonates any person or suggests a connection to a group or organisation which is misleading;

   (f)  advocates the use of force or violence towards any person;

   (g)  encourages, endorses, approves or recommends the performance of dangerous or illegal acts; or

   (h)  contains a virus or other code that has harmful or destructive properties.

5.  Reach Out will not access, monitor your use of, or disclose content that you post to My Reach Out except:
 
   (a)  to investigate possible breaches of the Member Terms;

   (b)  if a law requires or authorises the use or disclosure of content that you post to My Reach Out;

   (c)  if disclosure is reasonably necessary to enable an enforcement body to perform its function,        including:

        (i)  the prevention, detection, investigation, prosecution or punishment of criminal offences; and

        (ii)  the preparation for, or conduct of, proceedings before any court or tribunal, or                 implementation of the orders of a court or tribunal; or

   (d)  for use by us or our authorised nominees for internal research purposes (without, however, disclosing your identity or any other personal information that you may post).

6.  Subject to clause 5, Reach Out may in its discretion access, monitor and review all other content or material which you submit to the site. You grant Reach Out a perpetual royalty free, non-exclusive, irrevocable, world wide licence (with a right to sub-license to our authorized nominees) to use, modify, copy, distribute, transmit, reproduce, publish, display and broadcast that material on this site as well as in any promotional or communication activities of Reach Out conducted in Australia or overseas.

7.  Reach Out may, at any time, without notice to you, filter, remove or refuse to post files, content or other material which it considers in its discretion to be in breach of clause 4 of the Member Terms. Reach Out may also by written notification terminate your membership and/or suspend your access to the member sections of the site if you breach the Member Terms.

8.  You are solely responsible for any content or material which you post or upload on the site, or which is posted by another person using your user name or password. Reach Out excludes all liability (to the extent permitted by law) for any loss, damage or expenses suffered by you or claims made against you arising from content or material which you post or upload on the site, or which is posted by another person (whether using your user name or password or otherwise).

9.  Reach Out will take reasonable steps to ensure the security and confidentiality of material which  you post or upload onto the site. However, we cannot guarantee against any loss, damage, alteration or misuse of the content or material, and will not be responsible for any harm that you or any other person may suffer in connection with any loss, damage, alteration or misuse of material posted or uploaded onto the site.

10.  By submitting content or materials to this site, you consent to Reach Out exercising all rights in respect of such content or materials as are set out in these Member Terms even if the exercise of such rights would, but for this consent, infringe any moral rights that you may have in such content or materials.

11.  Reach Out may impose limits on the size of files uploaded by members into their member journals. Reach Out may also filter, remove or refuse to post files which interfere with the technical operations of the Reach Out network, including files which threaten to overload or crash a system. (Functionality that will be available with the launch of the My Reach Out section.)

12.  For details on how we deal with your personal information, refer to our Privacy Policy. You agree that Reach Out may publish on the site information concerning your activities on the site (including My Mood) but will not otherwise publish materials or content posted on My Reach Out. (Functionality that will be available with the launch of the My Reach Out section.)

13.  The Member Terms, your use of the site and any disputes between you and Reach Out will be governed by and construed in accordance with the laws of the State of New South Wales. You are solely responsible for ensuring that your use of the site is not prohibited and complies with your local laws.

14.  We may vary any of the Member Terms at any time by placing a notice on the site advising that the Member Terms have changed. You will be deemed to have accepted and agreed to the revised Member Terms if you continue to use any member section of the site after notice of the revised Member Terms has been placed on the site.

15.  If the Member Terms are acceptable to you, please indicate your agreement by clicking below on the button labeled  "I ACCEPT".
